Music Upload Terms (Pulse)

These terms apply when you submit a track or other content ("Submission") to Pulse or to be considered for the Mana Music Lab Vault. By uploading, you agree to these terms (the "Upload Terms"). If you do not agree, do not upload.

1. Eligibility

• You are at least 18 years old, or you have the consent of a parent or legal guardian who agrees to be bound by these terms on your behalf.

• The information you provide (including your name/artist name and email) is accurate, and you will keep it current.

2. Your rights and warranties

You represent and warrant that:

• You own, or have obtained all rights, licences and permissions necessary to upload the Submission and to grant the licence below — including rights in the composition, the sound recording, any samples, vocals, lyrics, performances and artwork.

• The Submission does not infringe any third party's intellectual-property, privacy, publicity or other rights, and does not contain unlawful content.

• Any collaborators, featured artists or rights-holders have authorised the upload and the free distribution described below.

3. Licence you grant to Mana H2O

You retain ownership of your Submission. You grant Mana H2O a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, transcode/reformat, stream, publicly display and perform, and make the Submission available for listening and free download through Pulse and the Mana Music Lab Vault, and to use the title, artist name and artwork to promote the platform. This licence lasts while the Submission remains on the platform and for a reasonable period needed to remove cached copies after takedown. 4. Free downloads

You acknowledge and agree that Submissions may be offered to the public as free downloads and streamed without charge. Participation is voluntary and unpaid unless separately agreed in writing.

5. Confirmations at upload

When you upload, you will be asked to confirm: (a) that you hold or control all necessary rights ("rights confirmed"); (b) that you understand you can request removal at any time ("removal acknowledged"); and (c) acceptance of the current version of these Upload Terms. We record these confirmations with your Submission.

6. Prohibited content

You must not upload content that is infringing, unlawful, defamatory, hateful, harassing, sexually exploitative of minors, deceptive, or that contains malware. We may refuse, moderate, or remove any Submission at our discretion.

7. Removal

You may request removal of your Submission by emailing privacy@mana-h2o.com; we will remove it within a reasonable time. We may also remove content under our Copyright & DMCA Takedown Policy or for any breach of these terms.

8. Indemnity and liability

You agree to indemnify Mana H2O against claims arising from your Submission or your breach of these terms. To the extent permitted by law, Mana H2O's liability in connection with Submissions is limited [lawyer to set cap and exclusions]. Nothing limits liability that cannot be excluded by law.

9. Governing law

These Upload Terms are governed by the laws of Portugal, and the courts of [JURISDICTION] have exclusive jurisdiction [lawyer to confirm].
